What Kind of Divorce Attorney Do You need?

There are many reasons why you would need a divorce attorney to act on your behalf.  Although the majority of settlements can be done without involving any lawyers.  If the parties are in agreement and are having an amicable arrangement, the work for a divorce attorney is kept to a minimum, that includes the cost.

However there are a few important aspects, that really do need a lawyer to a least make sure that all the boundaries of law are respected.  In this regard, it is always a good idea to find a lawyer, that is competent and can do the job quickly, and efficiently.  There is no point getting a lawyer that purposely drags out any proceedings, or perhaps, sabotages any agreement in order to have a longer standing, chargeable, relationship with the client.
If there are children involved then it to be done wise not to at least have the best advice from a lawyer that specializes in the field of child custody, and parental rights.  Also, it must be considered, to ascertain the living arrangements and conditions that are attached, such as in what town the children will reside, or even in what state, as in many cases, it would not be in the child’s best interest if one parent decides to take the child to another state where the other party could no longer exercise visitation rights.

Another main reason to find yourself a lawyer is if the other party has already taken legal advice.  In some cases the other party may not admit to have taken this course, it is up to the individual to realize whether or not the other party has made his attempt.  Not taking action will result in the advised party, having the upper hand in any settlement, and even entering into agreements knowing full well that there are other stipulations which are not in the contract but are upheld by law.

If you cannot see eye to eye in making an amicable agreement regarding property, or rather the division of personal asset, all feel that the division is very unfair, this is also a good reason to let least seek free advice.  This is especially more important if you yourself have more assets prior to the partnership, or marriage, and feel that these are assets should not be subject to the settlement.  Asset Management, and laws vary from state to state, and to know for sure what your state allows it is best to contact a qualified, and experience, and preferably notable, divorce attorney.

Does your spouse require support, without children? If your spouse has indicated that they might be asking for financial support, even if there are no offspring, or to children are not your own, then it is imperative that you visit a lawyer at the earliest opportunity.  There are many things a lawyer can do to stop an opposing lawyers advance into personal areas, and even into immoral territory.  To bind any attempt into unsound areas, the only defense would be the law.

Pensions are often an area that are forgotten, but this sometimes holds a considerable amount of funds, and these, after play qualifying period, can be used in argument as joint asset, especially if the pension, or the bulk, had again after the marriage date.
Are you a person that has difficulty in it representing yourself, you have a lack of confidence, do you give up easily? This is also the type of person that needs a lawyer, simply because you may give in far too easily, or be swayed by bullying tactics, and this would give an unfair advantage to your ex partner.  This is also the case if there has been violence within the partnership, and this does not necessarily mean that it was a male on female violence, it has been increasingly made known of the reverse and is becoming more acceptable as arguments in the cases of domestic violence.

These are all very good reasons why you would need to be represented by a qualified, and good professional, and that is the easy part!
